1.Scope & the school-consent model
myvirtualteacher.ai is provided to schools, districts, and authorized educational programs ("Schools"), not sold directly to individual families. Schools create the organization account, provision student and staff accounts, and are responsible for obtaining any parental consent or notice required by law before enabling a student's access to the Service.
With respect to student data, we act as a service provider / "school official" to the School under the Family Educational Rights and Privacy Act ("FERPA") and rely on the School's consent under the Children's Online Privacy Protection Act ("COPPA") where students are under 13 — the same model used by other classroom software providers. This Policy explains what information we collect, how we use it, and the choices available to Schools, parents, and students.
If you are a parent or student with questions about data collected through the Service, please contact your School first, as the School controls enrollment and account-level decisions; the School can also contact us directly on your behalf.
2.Information we collect
a. Information provided by Schools
- Roster information such as student first/last name, grade level, school-issued email or ID, and class or course assignment;
- Staff/administrator name, work email, and role;
- Billing and contact information for the School's account administrator.
b. Information generated through use of the Service
- Voice audio and transcripts from a student's spoken interactions with the AI avatar teacher;
- Text messages, responses, and answers a student submits during a session;
- Performance and progress data (for example, topics covered, accuracy, pacing, and session duration);
- Device, browser, and usage data (for example, log-in timestamps, session length, general device type, and diagnostic/error logs).
c. Information from visitors to our marketing website
- Contact details submitted through demo-request or contact forms;
- Standard analytics/cookie data about how visitors use myvirtualteacher.ai — see our Cookie Policy for details on what we use and how to control it.
We do not knowingly collect more information from students than is reasonably necessary to provide, support, and improve the Service.
3.How we use information
- To deliver and personalize the Service — running each session, adapting pacing and content to the student, and generating teacher/administrator reports;
- To improve the AI functionality of the Service — we use session audio, transcripts, and interaction data to train, evaluate, and improve the accuracy, responsiveness, and safety of the AI teaching models. Where this data is used beyond an individual School's own account, we use aggregated and/or de-identified data wherever feasible;
- To provide customer support and troubleshoot issues reported by Schools, teachers, or administrators;
- For safety and content moderation — for example, detecting and responding to harmful, unsafe, or policy-violating content in student sessions;
- To comply with legal obligations and enforce our Terms of Service.
We do not use student information to serve targeted advertising, and we do not build advertising profiles of students.
4.Legal frameworks & limits on use
Our processing of student information is governed by the written agreement between the School and Company (which may incorporate a student data privacy addendum, such as a National Student Privacy Consortium-style agreement) and, where applicable, the following frameworks:
- FERPA — we act as a "school official" with a legitimate educational interest, using student data only for the purposes authorized by the School and under the School's direct control, and we do not use or share student data for any purpose outside that scope.
- COPPA — for students under 13, the School provides consent on behalf of parents/guardians for the collection of personal information reasonably necessary for participation in the Service, consistent with COPPA's school-consent framework.
- State student data privacy laws (for example, laws modeled on California's Student Online Personal Information Protection Act) — we do not sell student information, do not use it to build a profile for a non-educational purpose, and do not use it for targeted advertising. Use of de-identified/aggregated data to maintain, support, and improve the Service is generally permitted under these frameworks and is the basis for how we use data to improve the AI as described above.
6.Data retention & deletion
We retain student data for as long as the School's account is active, and for a limited period afterward to allow the School to export records, unless a shorter period is required by our agreement with the School. Upon a School's written request, or upon termination of the School's agreement, we will delete or de-identify student personal information within the timeframe specified in our agreement with the School (typically within 90 days), except where we are required to retain it by law.
Aggregated or de-identified data that can no longer reasonably be linked to an individual student may be retained and used to improve the Service, consistent with Section 3.
7.Security
We use administrative, technical, and physical safeguards designed to protect student and School information, including encryption of data in transit, access controls limiting internal access on a need-to-know basis, and routine monitoring for security vulnerabilities. No system is completely secure, and we encourage Schools to report any suspected security issue to legal@myvirtualteacher.ai immediately.
8.Parents' & students' rights
Because Schools are the account holders and, under FERPA, generally the custodians of student education records, parents and eligible students should direct requests to review, correct, or request deletion of student information to their School first. The School can then work with us to fulfill the request, and we will support the School in doing so within the timeframes required by applicable law and our agreement with the School.
Where a School is unable to assist, parents or eligible students may also contact us directly at legal@myvirtualteacher.ai, and we will coordinate with the relevant School as needed.
9.Children's privacy (COPPA)
The Service is intended to be accessed by students, including students under 13, through their School's account and under the School's authorization. We rely on the School to provide any notice to and obtain any consent from parents/guardians required by COPPA before a student under 13 uses the Service, consistent with the FTC's school-consent guidance for education technology providers. We collect only the information reasonably necessary for a student to participate in the Service and do not use children's information for behavioral advertising.
A parent or guardian who has questions about a specific student's data, or who wishes to review or request deletion of that data, should contact the School; the School or parent may also contact us at legal@myvirtualteacher.ai.
10.State privacy rights
Depending on where you are located, you may have rights under state privacy laws (for example, the California Consumer Privacy Act, as amended) with respect to personal information we collect about School staff, administrators, or website visitors — such as the right to know, access, correct, or delete personal information, and the right to opt out of the sale or sharing of personal information. We do not sell personal information. To exercise these rights, contact legal@myvirtualteacher.ai. Because student data is governed by the School's agreement with us and by FERPA/COPPA as described above, requests concerning student data should generally be directed to the School first.
11.International data transfers
The Service is intended for use by schools and students located in the United States. If we process information from outside the United States, we take steps designed to ensure an adequate level of protection for that information in accordance with applicable law.
12.Changes to this policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify Schools by email or through the Service at least fourteen (14) days before the changes take effect. The "Effective date" at the top of this page indicates when it was last updated.
